    Install Gallery & spam legal issue

    1. I noticed that CPSkins.com don't have Gallery As one of their options.
    Will I be able to install it on my website (if I decide to move to dathorn )

    2. in the "Terms of Service" DIS stated zero tollerance on the spam and UCE email. I comlitly support this, since I hate spam, and I never send any. but, suppose someone makes a false acusation that I sent him spam ( this is very unlikely, but say, if he gave me his bussiness card, and forgot all about it, and regarded it as spam or if someone just want to hurt my business...). I don't see how can I prevent this from happening. in this case it is not reasnable that I will have to pay 250$ and 175$ per houer for investigating, espatially if you don't have any limit for the investigation's time - which could result in endless amout of money.
    I am not a lawyer, so I might misunderstood this, but agreeing to such a thing frightend me. could you clarify on this?

    You can install Gallery on your own. You can install nearly any program, unless its a resource hog (I think there's a FAQ with some examples, but things like IRC chat programs, "eggdrops", etc. are not allowed). I have Gallery on a couple of my sites, and it works fine. Because of phpSuExec, you have to CHMOD files a bit differently, using "755" instead of "777". You can search the forums here for more info or ask (you usually get an answer in the forums within an hour or so.)

    I can't really speak for Dathorn on the spam issue, but I think you wouldn't have a problem if a single person complained to Dathorn about a message they felt was spam. But, I think you WOULD have a problem if your URL shows up on one of the spam lists like the one maintained at Spamhaus.org. That gets the entire server IP address blocked, so it affects everyone else on the server. I suspect if that happened, your account would be suspended immediately pending a resolution so the server (and the rest of our sites) can be taken off the spam list.

    So far, I don't think anyone has had that problem here unless they actually did send out spam.

      An explanation on the issue regarding why you shouldn't worry about a mere accusation of spam:

      I get a lot of "undeliverable" email that results from automatic replies from servers (filters) that have received known spam that uses one of my email addresses. I didn't send it, I have no idea of where it might have originated, and I really don't care. Those kinds of messages have absolutely nothing for sale, but instead are testing for live email addresses to add to such nuisance lists, are attempting to kill the Internet system, etc. On my .edu email address, which doesn't have filters installed, I often get spam that shows my own email address as the sender. I'm not going to complain to myself that I spammed myself -- that is, don't worry about people complaining that you are a spammer if you are not. This is now merely the overhead associated with an open and free Internet, just like delays in checking in at the airport are the overhead associated with an open and free society.

      On the other hand, if you allow someone to have access to your account and they spam from it, I hope that you would get suspended very very quickly, and you should want that also. (E.g., someone might have hacked into your account because you left a door open, no different from leaving your suitcase unattended at the airport - *you* share responsibility either way.) This spam act would probably result in a block of addresses being placed on blacklist subscriptions -- these blacklists are used by ISPs and email providers to automatically delete email that originates on, say, a block of servers. So hundreds or thousands of innocent organizations on those servers might suddenly find that customers are not receiving their email for the next week or two. This single act of spam could put many people out of business if they rely on email for communication with customers.
